Real Estate Law

Transactional

Our attorneys handle the sale and acquisition of all types of real property, including office, retail, residential, industrial and undeveloped properties. These transactions typically involve extensive due diligence, as well as the negotiation and documentation of acquisition loans and construction financing. We assist clients in all aspects of the development process, including land acquisition, zoning, financing and analysis, and the negotiation of covenants and restrictions. The firm has extensive experience in representing both borrowers and lenders in financing, including conventional loans to complex security transactions. We have strong relationships with banks and other lenders enabling us to help clients secure optimal financing. Our firms also represents landlords and tenants throughout the region with respect to the leasing of retail, commercial, office, and industrial space. We also assist landlords and tenants in connection with all matters arising out of the landlord-tenant relationship.

Litigation

In addition to its extensive title insurance practice, the firm specializes in all aspects of real estate litigation, including claims arising out of acquisition, development, financing and leasing or sale of real estate, both commercial and residential. The firm represents large, medium, and smaller local home builders as well as real estate brokerages and agents throughout the Eastern half of the State of Missouri and Southern Illinois. The firm has defended real estate agents and brokers in ethics proceedings before the Missouri Real Estate Commission as well as various Boards of Realtors in both Missouri and Illinois.

Title Law

The firm represents title insurance underwriters’ policyholders in claims involving real estate throughout the state of Missouri.  Such claims involve resolving adverse claims to policyholders’ title, defending policyholders in litigation filed against them, and curing title defects in policyholders’ titles.  We litigate suits involving mechanic’s liens, lien and mortgage priority, reformation of instruments, adverse possession, easements, quieting title, real estate and mortgage fraud, declaratory judgment, and neighborhood/subdivision restrictions and indentures.

Zoning and Land Use Planning

Our firm provides a full range of legal and consulting services relating to both rezoning and general land use planning, including assisting in the both the application process, as well as handling public presentations to the various zoning boards and other governing boards.  Our services include full rezonings, requests for conditional/special use permits, variance requests before local boards of adjustment and so forth.
